On that Wednesday, May 10, 2017, Contreras was using a megaphone to \r\nbroadcast slogans at an opposition march on Avenida Vollmer in San Bernardino, \r\nLa Candelaria parish, in north-central Caracas. He was trying to mediate between \r\nthe marchers and a police squad that prevented the crowd from passing, according \r\nto witnesses of the event and Contreras' lawyer, Lilia Camejo. The photos of the \r\npolice taking him by force in a motorcycle freely circulated in the social \r\nmedia.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">He \r\nwas taken to the headquarters of the National Police and then transferred that \r\nsame day to the Bolivarian National Intelligence Service (Sebin, political \r\npolice) and, in the early hours of the next day, he arrived at the headquarters \r\nof the Directorate General of \r\nMilitary Counterintelligence \r\n(DGCIM), in the northeast of Caracas.<\/p>\n\n\n\t\t\t\t<figure class=\"wp-block-embed is-type-rich is-provider-embed-handler wp-block-embed-embed-handler wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n\t\t\t\thttps:\/\/youtube.com\/watch?v=nmp7Z9-JQe0\n\t\t\t\t<\/div><\/figure>\n\t\t\t\t\n\t\t\t\t \n\n<p class=\"wp-block-paragraph\">The \r\nroulette of transfers ended on Friday, May 12, at night, at the First Military \r\nCourt of Proceedings of Caracas before which Contreras was presented. That court \r\nis led by Captain Claudia Carolina P\u00e9rez de Mogoll\u00f3n, a lawyer with a diploma \r\nfrom Centro de Estudios del Ej\u00e9rcito y Fuerza A\u00e9rea Mexicana (Mexican Army and \r\nAir Force Studies Center) with a major in Human Rights and Armed Forces. Her \r\ncurriculum certifies studies on Human Rights in Fundaci\u00f3n \"Juan Vives Suria,\" \r\nattached to the Ombudsman's Office.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Like \r\nContreras, hundreds of civilians have been presented before military courts \r\nsince the opposition protests began on April 1, 2017 ?a real intifada to demand \r\nthe Supreme Court of Justice (TSJ) to respect the autonomy of the National \r\nAssembly and call for general elections to overcome the political crisis, among \r\nother demands.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">According \r\nto leaks of the meeting that Nicol\u00e1s Maduro had last week with the military high \r\ncommand, ?which the electronic press has echoed and opposition leader Henrique \r\nCapriles Radonski also broadcasted?the Venezuelan president informed the \r\nofficers of his intention to transfer to the martial justice the street \r\ndemonstrators under arrest, whose cases the Public Prosecutor\u2019s Office will not \r\naccept to process. That was his way to overcome the obstacle now imposed by an \r\nunexpectedly indocile Prosecutor\u2019s Office led by Luisa Ortega D\u00edaz against his \r\nefforts to stifle the civil rebellion that began in April 2017. Whether a \r\ndeliberate strategy or not, the ongoing claims from human rights organizations \r\nallow verifying that in the fight against the revolt that began 50 days ago, the \r\nGovernment is opting ?without further regard to local regulations and \r\ninternational standards? to try civilians before military \r\ncourts.<\/p>\n\n\n<figure class=\"wp-block-pullquote alignleft\"><blockquote><p>Six out of ten accused in military courts were arrested in the State of Carabobo<\/p><\/blockquote><\/figure>\n\n\n<p class=\"wp-block-paragraph\">According \r\nto data from the Foro Penal Venezolano (Venezuelan Criminal Forum) - a \r\nnon-governmental organization that assists political detainees -, as of May 17, \r\n295 civilians had been presented before military courts, 161 of which were \r\ndeprived of their liberty in violation of article 49 of the Constitution in \r\nforce, which reads?\"Everyone has the right to be judged by their natural judges \r\nin ordinary or special jurisdictions with the guarantees provided for in this \r\nConstitution and the law.\" In addition, there are 14 detainees in Nueva Esparta \r\nwho were sent to the Sixteenth Military Court of proceedings based in \r\nBarcelona.<\/p>\n\n\n<p class=\"wp-block-paragraph\">Six \r\nout of ten people tried in military courts were arrested in the state of \r\nCarabobo, in the central region of the country, which has been the scenario of \r\nmajor disturbances. It may be purely coincidental, but the judge with the \r\nlongest time in position in the national military jurisdiction, Major Luz \r\nMariela Santaf\u00e9 Acevedo, appointed in November 2011 and ratified in late 2016, \r\nworks in the court of proceedings of Valencia, the capital of the state. \r\nAccording to Roc\u00edo San Miguel, director of the organization Citizen Control for Security, Defense and the Armed Forces, such an extended term \r\ncan result in perversions of court practices.<\/p>\n\n<div class=\"lazyblock-embed-script-lv2VYH wp-block-lazyblock-embed-script\"><iframe loading=\"lazy\" src=\"https:\/\/katherine.carto.com\/viz\/97b07914-3caa-11e7-aa13-0ee66e2c9693\/embed_map\" allowfullscreen=\"\" webkitallowfullscreen=\"\" mozallowfullscreen=\"\" oallowfullscreen=\"\" msallowfullscreen=\"\" width=\"100%\" height=\"520\" frameborder=\"0\"><\/iframe><\/div>\n\n<h2 class=\"wp-block-heading\">Justice or Duly Obedience<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Just \r\nas there is an ordinary judicial circuit, the military has its own circuit of \r\njustice that is made up of Military Courts of First Instance, led by judges who \r\ndischarge the duties of Proceedings, Trial and Enforcement of Judgement, and the \r\nCourt Martial, acting as Court of Appeals and Constitutional Court with national \r\njurisdiction, led by five professional judges.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">The \r\ncourtroom of the court martial is made up of a presiding judge, Major General \r\nHenry Jos\u00e9 Timaure Tapia; a chancellor, Jos\u00e9 de la Cruz Vivas S\u00e1ez; a court \r\nreporter, Colonel Jes\u00fas E. Gonz\u00e1lez Monserrat; a first officer, Carmen Luc\u00eda \r\nSalazar Romero; and a second officer, Edmundo Ram\u00f3n Mujica \r\nS\u00e1nchez.<\/p>\n\n\n<figure class=\"wp-block-pullquote alignleft\"><blockquote><p>Everything suggests that the number of cases and regions involved will increase<\/p><\/blockquote><\/figure>\n\n\n<p class=\"wp-block-paragraph\">There \r\nare 19 courts of proceedings, five trial courts and seven enforcement courts in \r\nthe entire military jurisdiction. Its judges, 45 magistrates, have jurisdiction \r\nover the future of military accused of committing a crime, but with the new \r\ndoctrine that the Government of Nicol\u00e1s Maduro tries to impose, they also have \r\njurisdiction on civilians accused of military crimes. Obviously, not all of them \r\nare currently deliberating on the fate of the 161 civilians referred to military \r\ncourts during street protests. According to reports from social media, this has \r\nhappened in Caracas and in states like Carabobo, Barinas, T\u00e1chira and Nueva \r\nEsparta. However, everything suggests that the number of cases and regions \r\ninvolved will increase.<\/p>\n\n\n<p class=\"wp-block-paragraph\">These \r\njudges have been handpicked by the Ministry of Defense. Although the Internal \r\nRegulation of the Military Criminal Judicial Circuit provides that the members \r\nof the Court Martial will be appointed by the Supreme Court, it is done through \r\na list sent by the Ministry and not through a contest, as established by the \r\nConstitution, Ali Daniels, director of the Access to Justice organization, \r\nexplains.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Moreover, \r\naccording to Official Gazette 40.462 of July 28, 2014, it was the Ministry of \r\nDefense who appointed without objections Military Public Prosecutor Siria \r\nVenero, Military Public Defender Oscar Alfredo Gil Arias, and the Presiding \r\nJudge of the Court Martial. All remain in office and have been holding their \r\nposition for nearly three years, contrary to the convention that provides for \r\nthe constant rotation of these positions, which the Bolivarian Revolution has \r\nvirtually turn into a mantra.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">\"The \r\nSupreme Court of Justice endorsed this usurpation of its own duties, and with \r\nconfidently published a <a title=\"Nota de prensa - TSJ\" href=\"http:\/\/www.tsj.gob.ve\/noticiastsj\/-\/asset_publisher\/yCHb0RSxwqUX\/content\/magistrada-gladys-maria-gutierrez-alvarado-juramenta-nuevo-presidente-de-la-corte-marcial-y-circuito-penal-militar?_101_INSTANCE_yCHb0RSxwqUX_redirect=%2Fnoticiastsj%3Fp_p_id%3D101_INSTANCE_yCHb0RSxwqUX%26p_p_lifecycle%3D0%26p_p_state%3Dnormal%26p_p_mode%3Dview%26p_p_col_id%3D_118_INSTANCE_BKfqdT3FLgdQ__column-1%26p_p_col_count%3D1%26_101_INSTANCE_yCHb0RSxwqUX_delta%3D10%26_101_INSTANCE_yCHb0RSxwqUX_keywords%3D%26_101_INSTANCE_yCHb0RSxwqUX_advancedSearch%3Dfalse%26_101_INSTANCE_yCHb0RSxwqUX_andOperator%3Dtrue%26p_r_p_564233524_resetCur%3Dfalse%26_101_INSTANCE_yCHb0RSxwqUX_cur%3D63\" target=\"_blank\" rel=\"noopener\">press \r\nrelease<\/A>&nbsp;informing \r\nthat this Court swore in the new presiding judge of the Court Martial without \r\nexplaining that it did not appoint him and submissively accepted the \r\nunconstitutionally decision of the Minister of Defense,\" says the Access to \r\nJustice spokesperson.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Ironically \r\ncontrasting, since 2011, the Ministry of Defense stopped publishing military \r\njustice appointments in the Official Gazette. As provided for by the Internal \r\nRegulations of the Military Criminal Judicial Circuit, since that date, the \r\nappointments of judges, magistrates and military public defenders - in short, \r\nmembers of the jurisdiction, excluding administrative and accounting staff - \r\nappear on the Supreme Court\u2019s website.&nbsp;<\/p>\n\n\n<h2 class=\"wp-block-heading\">Executive Connection<\/h2>\n\n\n<p class=\"wp-block-paragraph\">The \r\nmodality is not new though. Previous cases now look like tests to measure the \r\nwillingness of the military justice apparatus to take civil \r\ncases.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Among \r\nthem, one case of September 2016 stands out. At that time, the Primero Justicia \r\n(Justice First) party circulated a video on the media showing a recreation of \r\nmilitary staff suffering, like any other citizen, the problems of the economic \r\nand political crisis that the country is going through. That is why producers \r\nMarco Trejo, C\u00e9sar Cuellar and James Mathison were arrested and referred to \r\nmilitary courts.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">On \r\nthat occasion, the chief justice of the Supreme Court of Justice, Maikel \r\nMoreno,?sanctioned this week by the US Department of Justice?,<a title=\"TSJ\" href=\"http:\/\/historico.tsj.gob.ve\/decisiones\/scp\/diciembre\/193571-518-61216-2016-CC16-383.HTML\" target=\"_blank\" rel=\"noopener\">&nbsp;ordered<\/A>&nbsp;\"to \r\nremove this case from said jurisdiction and refer it to its natural \r\njurisdiction, as the ordinary criminal jurisdiction, for the process to continue \r\nensuring the protection of rights and constitutional \r\nguarantees.\"<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">In \r\nspite of this precedent, now the Judiciary - under strict control of the \r\nExecutive - agrees to accept the prosecution of civilians by military courts. \r\nThe change is likely to be due to the need to evade the sphere of influence of \r\nGeneral Prosecutor Luisa Ortega D\u00edaz. From the dependence of military judges \r\nwith the Ministry of Defense, another line of command is deduced, one that \r\nconnects them with the Commander in Chief of the Armed Forces, Nicol\u00e1s Maduro, \r\npresident of the Republic.<\/p>\n\n<div class=\"kb-gallery-wrap-id-_0JZ6F5-FU alignnone wp-block-kadence-advancedgallery\"><div class=\"kb-gallery-ul kb-gallery-non-static \r\nTreason against the Homeland and Subtraction of Elements from the Armed Forces. \r\nHe was sent to the military prison of Ramo Verde, in the mountains southwest of \r\nCaracas, where the most well-known political prisoner of the Bolivarian \r\nRevolution and party companion, Leopoldo L\u00f3pez, former mayor of Chacao \r\nmunicipality (northeast of Caracas), has also been confined for three \r\nyears.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">His \r\nfamily has not been able to see him. They demand \u2013 still without success - to \r\nknow about his health and imprisonment conditions. His lawyers expect the \r\ndelivery of copies of actions and appointment of the defense to go to Ramo Verde \r\nand try to see him.
