{"id":2441,"date":"2016-05-08T13:13:31","date_gmt":"2016-05-08T13:13:31","guid":{"rendered":"https:\/\/armando.info\/?p=2441"},"modified":"2016-05-08T13:13:31","modified_gmt":"2016-05-08T13:13:31","slug":"sarah-moya-the-pdvsa-executive-who-moves-in-overseas-territories","status":"publish","type":"post","link":"https:\/\/armando.info\/en\/sarah-moya-the-pdvsa-executive-who-moves-in-overseas-territories\/","title":{"rendered":"Sarah Moya, the PDVSA Executive who Moves in Overseas Territories"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">In \r\nApril 2011, the then manager of Pdvsa Gas Colombia, Sarah Moya, received a \r\npower-of-lawyer to manage a company registered by Mossack Fonseca in the British \r\nVirgin Islands. The documents revealed do not indicate the use given to that \r\ncompany, but according to the Spanish newspaper ABC, Moya is involved in an \r\ninvestigation by the Andorran authorities for money laundering from contracts of \r\nthe Venezuelan oil company, and it would have as launch point the same Caribbean \r\ntax haven where the above company was registered.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Six \r\nmonths after the registration of company Helmont Finance Corporation, on \r\nDecember 16, 2011, the Panamanian law firm received two emails requesting the \r\ndissolution of the company, one from the account of the representative of the \r\nstate oil company. Moya ratified the request to dissolve the company with a \r\nletter of January 10, 2012. \"Please process this instruction at your earliest \r\nconvenience and confirm your execution by email to Pablo Escudero as soon as it \r\nis processed,\" it is read before the signature of the former senior officer of \r\nPdvsa Gas Colombia.<\/p>\n\n\n<p class=\"wp-block-paragraph\">Helmont \r\nFinance Corporation was incorporated in the British Virgin Islands on June 23, \r\n2011. Since the beginning of the procedure, Moya was represented by Colombian \r\nlawyer Natalia Mulford, who was then working in Panama for company Family \r\nCouncil Wealth Consulting Planning (FCWCP), founded in Bogota by the expert in \r\ncompany advising on succession matters, Ra\u00fal \r\nSerebrenik.<\/p>\n\n\n<h2 class=\"wp-block-heading\">The Panamanian Efforts<\/h2>\n\n\n<p class=\"wp-block-paragraph\">\"I \r\nhave my client's instructions to incorporate a company in the British Virgin \r\nIslands. I have the format for the new structures ready, but before sending it, \r\nI wanted to confirm that I do not have to send more documents... My partner, \r\nRa\u00fal Serebrenik, through FCWPC Colombia, is registered with you as a referrer. \r\nDo I need to complete the documents again or is it enough with what he \r\ncompleted? (sic)... I look forward to your comments,\" wrote the \r\nlawyer.<\/p>\n\n\n<figure class=\"wp-block-image size-medium\"><img loading=\"lazy\" decoding=\"async\" width=\"881\" height=\"471\" src=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-4.jpg\" alt=\"\" class=\"wp-image-52259\" srcset=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-4.jpg 881w, https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-4-700x374.jpg 700w, https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-4-768x411.jpg 768w\" sizes=\"auto, (max-width: 881px) 100vw, 881px\" \/><figcaption>Email from Moya's lawyer to Mossack Fonseca<\/figcaption><\/figure>\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Mulford \r\nthen requested the incorporation of company Helmont Finance Corporation in the \r\nBritish Virgin Islands. Five days later, on June 22, the Panamanian law firm \r\nanswered that all the paperwork had already been completed. The next day, the \r\ncompany was incorporated.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">They \r\nused a Panamanian woman who lent her name, Connie Hidalgo, who acted as \r\ndirector, unlike other cases, where the figureheads were Mossack Fonseca \r\nworkers. Lawyer Mulford gave the law firm a passport and other information from \r\nthe director to facilitate the process.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Hidalgo \r\ntransferred the 50 thousand shares of the company, according to the registration \r\nmade, to Sarah Moya, at which time she receives the ownership of this offshore \r\ncompany. In addition, \"the original documents of the company will be \r\nmaintained,\" Mulford then clarified, in an address in Caracas that this \r\njournalistic investigation later identified as the apartment of a relative very \r\nclose to the former PDVSA manager in Colombia.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">At \r\nthe time of the registration of the company by Mossack Fonseca, Moya was in \r\nBogota. As in the cases of PDVSA former auditor Jes\u00fas Villanueva, and former \r\nVice President of Finance Eudomario Carruyo, the Compliance Department of \r\nMossack Fonseca checked Moya and activated an early warning because she was a \r\nPolitically Exposed Person. In 2005, she was the Head of the International \r\nAffairs Department of the Ministry of Energy and Petroleum, when Rafael Ram\u00edrez \r\nwas already in charge. Curiously, the investigation of the law firm did not \r\nreveal that at that time, she was the manager of Pdvsa Gas Colombia. That is why \r\nfrom June to December 2011, she managed the shell company without any \r\ninconveniences.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">That \r\nnormality was maintained until December 16 of that year. That day, the employees \r\nof Mossack Fonseca first read the message sent by a man named Pablo Escudero, \r\nwho wrote from the email of financial company EFG Capital, based in Brickell, \r\nMiami. A few hours later, Moya ratified the request from the wanadoo.fr email \r\nplatform. This investigation identified the former manager as the owner thereof: \r\n\"Good afternoon. This is to confirm the request for dissolution as soon as \r\npossible.\" It was Sarah Moya's address. The next day, the Panamanian law firm \r\ncontacted Mulford, as the representative recognized by them, and bound itself to \r\nprocess everything necessary to fulfill the request of the \r\nshareholder.<\/p>\n\n\n<figure class=\"wp-block-image size-medium\"><img loading=\"lazy\" decoding=\"async\" width=\"882\" height=\"472\" src=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-5.jpg\" alt=\"\" class=\"wp-image-52260\" srcset=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-5.jpg 882w, https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-5-700x375.jpg 700w, https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-5-768x411.jpg 768w\" sizes=\"auto, (max-width: 882px) 100vw, 882px\" \/><figcaption>Moya's email confirming her request<\/figcaption><\/figure>\n\n\n<p class=\"wp-block-paragraph\">In \r\nMarch 2012, the liquidation process of Helmont Finance Corporation was \r\ncompleted, but Mulford requested in parallel services from Mossack Fonseca to \r\nregister a company in two US regions, Florida and Delaware, which is considered \r\na tax haven. Mulford later reported that the client, without mentioning first \r\nand last name, preferred to stay in the British Virgin \r\nIslands.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">The \r\ninformation on the transaction and dissolution of Helmont Finance is known due \r\nto a leak of emails and other files of Mossack Fonseca - a law firm founded in \r\nPanama for legal and financial advice in tax havens -, obtained by the \r\nInternational Consortium of Investigative Journalists \r\n(ICIJ).<\/p>\n\n\n<h2 class=\"wp-block-heading\">Trusted Staff<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Moya \r\nis an internationalist graduated from Universidad Central de Venezuela, with \r\nhigher education at the Sorbonne in Paris, and work experience in the country \r\nand abroad. Her professional career links her to Rafael Ram\u00edrez, former \r\npresident of PDVSA, former Minister of Energy and Petroleum and today ambassador \r\nto the UN. The biographical evidence places her very close to Diego Salazar, the \r\ninsurance broker and cousin of Ram\u00edrez, linked to the case of money laundering \r\nat Banco Privado de Andorra.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Diego \r\nSalazar Luongo and Quint\u00edn Moya, parents of the insurance broker and the former \r\nPdvsa manager, respectively, participated in the 60\u2019s guerrilla, and even shared \r\na cell and escaped in the San Carlos barracks, in Caracas, together with other \r\nleaders of the then left, like Teodoro Petkoff.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Even \r\none of Moya's aunts is currently married to Rafael Salazar, who was the Human \r\nResources manager of Pdvsa in the administration of his cousin Rafael Ram\u00edrez. \r\nThis Salazar is also Diego's cousin.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">At \r\nthe beginning of the first decade of this century, Moya met in London Bernard \r\nMommer, who was adviser to Ram\u00edrez and President Hugo Ch\u00e1vez, and also an Oxford \r\nprofessor. The oil expert invited her to continue her studies in \r\nEngland.<\/p>\n\n\n<figure class=\"wp-block-image size-medium\"><img loading=\"lazy\" decoding=\"async\" width=\"700\" height=\"450\" src=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-6.jpg\" alt=\"\" class=\"wp-image-52261\"\/><figcaption>The former manager of PDVSA has been linked to the insurance broker, Diego Salazar, who is also a cousin of former minister Rafael Ram\u00edrez<\/figcaption><\/figure>\n\n\n<p class=\"wp-block-paragraph\">In \r\nher r\u00e9sum\u00e9, she affirms that from 2001 to 2002, she worked as technical \r\nassistant to the vice minister of Hydrocarbons in Venezuela. In January 2005, \r\nshe came to Caracas with Mommer -recently appointed vice minister of \r\nHydrocarbons - to assumed the position of head of the International Affairs \r\nDepartment of the Ministry of Energy and Petroleum, which she held for less than \r\n10 months. She was then sent to London again, to the headquarters of PDV UK. She \r\nstayed in London for one more year only, because the parent company closed the \r\noffice in that city. Since she was unemployed, she went to Colombia, where Pdvsa \r\nbegan negotiations to open an office. Rafael Ram\u00edrez appointed her as manager of \r\nPdvsa Gas Colombia, in charge of the construction and administration of the \r\nAntonio Ricaurte binational gas pipeline.<\/p>\n\n\n<h2 class=\"wp-block-heading\">The Wake of Bitterness<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Asking \r\nabout Moya to her former co-workers is equal to finding traces of bitter \r\ndisputes, arguments, recriminations and accusations. It happened to her in \r\nCaracas, where she had differences with La Campi\u00f1a employees; in London, a \r\nformer colleague prefers not to speak about her, although the little she says is \r\nnot kind; and in Colombia, a country where she had confrontation not only with \r\nher supervisors, but also with representatives of Way\u00fau communities, through \r\nwhich the gas pipeline passes.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">The \r\nSiente Am\u00e9rica website has a file of complaints from former employees of Pdvsa \r\nGas Colombia and representatives of the Way\u00fau, which has published in several \r\nissues, documents provided for this report.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Based \r\non the information provided by the digital media, the representative of the La \r\nCi\u00e9naga oversight office, Jos\u00e9 Morales, would be one of those who filed a \r\ncomplaint with the Colombian Prosecutor's Office. He says in the communication \r\nwithout an specific date that \"after the relevant follow-up by this oversight \r\noffice, we found multiple inconsistencies in the expenses of PDVSA in Colombia; \r\nand it even seems that the shortages generated on the one hand, in the case of \r\nmonies that do not go to WAYUU communities, swelled the personal and private \r\neconomic assets of manager MOYA MACHADO.\"<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">In \r\nOctober 2009, a group of indigenous people complained to the official of the \r\nVenezuelan oil company for the breach of a deed of commitment signed in 2008. \r\n\"The people in PDVSA are mocking us and National Government officials allow them \r\nto do it,\" said the Way\u00fau leaders who took the facilities of the Ombudsman's \r\nOffice in the Colombian Guajira for 10 days.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">In \r\nthe workplace, former employee Yaneth Anaya Est\u00e9vez, dismissed in 2009 from her \r\njob, told in a letter sent to authorities of the Venezuelan oil industry that \r\nshe was fired because she requested a permit to undergo medical examinations. \r\nShe states in the letter that Moya made them work 12-14 hours on average, \r\nverbally mistreated them, lacked knowledge for the position she held and made \r\ncontinuous layoffs on a whim. The former official did not want to talk much \r\nabout her former boss. \"I know that that woman managed the office as if it were \r\nher home and there were irregular money movements,\" said Anaya Est\u00e9vez. She \r\npointed out by email that she did not receive any response from the executives \r\nof the Venezuelan state oil company.<\/p>\n\n\n<figure class=\"wp-block-image size-medium\"><img loading=\"lazy\" decoding=\"async\" width=\"2168\" height=\"1536\" src=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-7.jpeg\" alt=\"\" class=\"wp-image-52262\" srcset=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-7.jpeg 2168w, https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-7-700x496.jpeg 700w, https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-7-768x544.jpeg 768w, https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/PP-7-700x496@2x.jpeg 1400w\" sizes=\"auto, (max-width: 2168px) 100vw, 2168px\" \/><figcaption>Certificate of Sarah Moya\u2019s company, manager of the PDVSA office in Colombia<\/figcaption><\/figure>\n\n\n<h2 class=\"wp-block-heading\">Money Laundering in Andorra<\/h2>\n\n\n<p class=\"wp-block-paragraph\">All \r\nthese complaints, according to Siente Am\u00e9rica digital portal, were presented to \r\nthe authorities of Venezuela and Colombia. The medium also refers to another \r\ncase beyond the Colombian-Venezuelan borders. It is about the laundering of \r\nmoney from Pdvsa in Banco Privado de Andorra.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">The \r\nformer manager of Pdvsa Gas Colombia is next to the names of other senior \r\nofficials of the state oil company, as the only woman investigated for money \r\nlaundering in Banco Privado de Andorra, where, according to official \r\ninformation, over 1,400 million euros of deposits of industry leaders were \r\nadmitted.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">In \r\nMay 2015, according to the story published by the Spanish newspaper ABC, the \r\njudicial authorities of the Principality of Andorra sent two rogatory letters to \r\nUSA and Venezuela to request banking information about senior PDVSA \r\nofficials.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">The \r\ndocument sent by Andorra and partially reproduced by the newspaper describes the \r\norigin and the way in which the officials were could carry out the laundry \r\noperation. \"From 2006 until late 2012, financial transactions have been detected \r\nbetween individuals and legal entities that are related for the investigations. \r\nAs a common denominator - the document adds -, the participating individuals are \r\nnative of Venezuela and the companies used to transfer the funds from abroad to \r\nthe Principality of Andorra or vice versa are mostly from Panama, Belize or the \r\nBritish Virgin Islands... The money circulating internationally - the rogatory \r\ncommission specifies - would have a criminal origin due to political corruption \r\nand\/or would come from officials of the Venezuelan State\u00bb, and adds that a good \r\npart of the funds would also come from overvalued insurance contracts whose \r\nholders would be Venezuelan public companies.\u201d<\/p>\n\n\n<h2 class=\"wp-block-heading\">Replaced by Ex Sister-in-Law<\/h2>\n\n\n<p class=\"wp-block-paragraph\">To \r\ncompare the information for this report, the former manager of Pdvsa Gas \r\nColombia was contacted through the email address she used to request the \r\nliquidation of the company on December 16, 2011. Two days after, she responded \r\nand an agreed to have an interview via Skype. However, she refused for the \r\ncontent of a one hour and 20 minute conversation to be used when this report was \r\nin the final stage. Security reasons were stronger than her will to clarify what \r\nshe claims to be a smear campaign.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Only \r\none of the other three persons involved in this case answered. Serebrenik \r\nresponded to the request for information through a message on LinkedIn. \"...I am \r\ntotally unaware of what you are talking about. I suggest you to contact lawyer \r\nNatalia Mulford. I do not know Sara Moya (sic),\" he said in 24 words. After \r\ninsisting through a new message, the adviser said, \"We are a company advising \r\nfirm of family companies and boards of directors only. I never heard the name \r\nMoya.\"<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">By \r\nthe time Serebreik suggested addressing the \"lawyer,\" Mulford had already been \r\nsent three emails to her office in Panama, without obtaining information on the \r\nreasons of her actions in this case. Finally, an unsuccessful attempt was made \r\nto contact Escudero through his former co-workers at EFG Capital. That is why \r\nyou can only know the stories told in the Panama papers.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Moya \r\nis out of PDVSA since August 2015, after being replaced in the management of the \r\nBogota office by Laura Guerra Angulo, sister of the ex-wife of President Nicol\u00e1s \r\nMaduro, and aunt of the only known son of the national president.
