{"id":2410,"date":"2016-05-08T15:48:17","date_gmt":"2016-05-08T15:48:17","guid":{"rendered":"https:\/\/armando.info\/?p=2410"},"modified":"2016-05-08T15:48:17","modified_gmt":"2016-05-08T15:48:17","slug":"former-president-of-banco-industrial-de-venezuela-and-owner-of-offshore-companies","status":"publish","type":"post","link":"https:\/\/armando.info\/en\/former-president-of-banco-industrial-de-venezuela-and-owner-of-offshore-companies\/","title":{"rendered":"Former President of Banco Industrial de Venezuela and Owner of Offshore Companies"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On \r\nFebruary 11, 2016, the history of Banco Industrial de Venezuela (BIV) ended. A \r\nresolution of the Superintendency of Banking Institutions (Sudeban) was the \r\ndeath certificate for a financial institution that was born in \r\n1937.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">\"Agreeing \r\nthe early dissolution of Banco Industrial de Venezuela, C.A. and the cessation \r\nof operations and financial intermediation activities and, thus, beginning the \r\nadministrative liquidation process,\" provides Article 1 of the measure contained \r\nin Official Gazette 40.846.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">But \r\nthe end of BIV was written long ago. In 2011, the Office of the Comptroller \r\nGeneral of the Republic (CGR) recommended ending the \"intervention process,\" \r\nwhich the bank was subject to since 2009. It advised its \"liquidation\" in \u201corder \r\nto preserve the interests of the Republic, the stability of the national \r\nfinancial system, and the rights of savers, depositors, customers and creditors, \r\ngiven that the bank had serious economic, financial and budget planning problems \r\nin 2007 and 2008.\"<\/p>\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Major \r\nlosses, interventions and bailouts from the Government every so often were \r\nconstant in the bank. The red figures were also part of the bad management and \r\nthe permanent turnover of BIV\u2019s board. In the first eight years of Hugo Ch\u00e1vez \r\ngovernment, the bank had up to eight presidents.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">One \r\nof them was Leonardo Gonz\u00e1lez Dell\u00e1n, who, based on the papers of the Panamanian \r\nlaw firm Mossack Fonseca, is the beneficiary of several companies in tax havens. \r\nGonz\u00e1lez Dell\u00e1n was appointed by Ch\u00e1vez to head BIV in 2002 and held office \r\nuntil 2004, when he was replaced by Arn\u00e9 Chac\u00f3n, the brother of former minister \r\nJesse Chac\u00f3n, who was arrested in 2009 in connection with the financial crisis \r\nthat year.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">The \r\ndocuments of Mossack Fonseca law firm, which S\u00fcddeutsche Zeitung of Munich \r\nreceived from an anonymous source and were reviewed by a team of over 370 \r\njournalists around the world under the coordination of the International \r\nConsortium of Investigative Journalists (ICIJ), prove that Gonz\u00e1lez Dell\u00e1n was \r\nlinked to offshore companies since he was at the head of \r\nBIV.<\/p>\n\n\n<h2 class=\"wp-block-heading\">Route to Panama<\/h2>\n\n\n<p class=\"wp-block-paragraph\">An \r\nemail between executives of the Panamanian law firm dated April 4, 2013, leaves \r\nno doubt about the client. \"In the Supreme Court of Justice of Venezuela there \r\nis a document in which Leonardo Gonz\u00e1lez Dell\u00e1n acts as representative of Banco \r\nIndustrial de Venezuela (BIV). This document indicates the full name and \r\npersonal identification number that exactly matches the document of our \r\ndirector,\" the communication reads. It even details that \"the contact of \r\nLeonardo Gonz\u00e1lez Dell\u00e1n with Hugo Ch\u00e1vez was also found.\"<\/p>\n\n\n<figure class=\"wp-block-image size-medium\"><img loading=\"lazy\" decoding=\"async\" width=\"768\" height=\"576\" src=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/pp-2.jpg\" alt=\"\" class=\"wp-image-52041\" srcset=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/pp-2.jpg 768w, https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/pp-2-700x525.jpg 700w\" sizes=\"auto, (max-width: 768px) 100vw, 768px\" \/><figcaption>After 79 years of activity, Banco Industrial de Venezuela was liquidated this year. Photo: Creative Commons<\/figcaption><\/figure>\n\n\n<p class=\"wp-block-paragraph\">The \r\nfirst emails related to Gonz\u00e1lez Dell\u00e1n go back to 2010, but the papers of the \r\ncompanies reveal that he was related to a company, whose settlement agent was \r\nMossack Fonseca, since 2003.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">The \r\ncompany is Blue Crest Holdings S.A., a company registered in Panama on August \r\n20, 2003. \"The authorized capital of the company is US $ 10,000, legal tender of \r\nthe United States of America, divided into 100 shares that may be registered or \r\nbearer, at a par value of US $ 100 each. The board of directors may allow bearer \r\ncertificates to be exchanged for certificates in the name of the owner and vice \r\nversa,\" reads the company's social agreement, a kind of articles of \r\nincorporation.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">On \r\nAugust 21, 2003, four bearer certificates were issued, equal to one share each. \r\nOn July 23, 2014, a fifth certificate for 100 shares was issued in favor of \r\nLeonardo Gonz\u00e1lez Dell\u00e1n. But the relationship of the former president of BIV \r\nwith company Blue Crest Holdings S.A. did not end there.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">On \r\nOctober 20, 2003, the directors of Blue Crest Holdings S.A., appointed by \r\nMossack Fonseca for that purpose, conferred Jos\u00e9 \u00c1ngel Gonz\u00e1lez Dell\u00e1n a Power \r\nof Attorney to \"manage the company without any limitation.\" He is the brother of \r\nthe former president of BIV, who, based on the National Registry of Contractors \r\n(RNC), is the president of the Asociaci\u00f3n Cooperativa Colosal XX, R.L., a \r\ncompany that has provided services to Petr\u00f3leos de Venezuela (Pdvsa), as varied \r\nas the \"supply of meals\", \"office construction and remodeling,\" and \"road \r\nconstruction and signaling,\" among others.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">Also \r\non October 20, 2003, a Power of Attorney was issued in favor of Luis Alberto \r\nBenshimol, an investment advisor who was linked to several securities firms such \r\nas Lemon Casa de Bolsa in 2003 and later to Bencorp Casa de Bolsa C.A., one of \r\nthe many intervened by the National Securities Commission in 2010, after the \r\nthen Minister Jorge Giordani decided to finish with the \r\nsector.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">As \r\nof July 21, 2005, Leonardo Gonz\u00e1lez Dell\u00e1n had a Power of Attorney without \r\nlimitations to manage Blue Crest Holdings S.A. <\/p>\n\n\n<h2 class=\"wp-block-heading\">Foreign Exchange Control and Parallel Market<\/h2>\n\n\n<p class=\"wp-block-paragraph\">The \r\nperiod of Gonz\u00e1lez Dell\u00e1n at the head of BIV coincides with the beginning of \r\nforeign exchange control decreed by Ch\u00e1vez in February 2003 and still in force, \r\nas well as with the origin of the extinct Currency Administration Commission \r\n(Cadivi). Several press releases from El Universal, published between 2003 and \r\n2004 reveal BIV\u2019s participation at that time.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">On \r\nDecember 31, 2002, in the midst of the so-called \"oil strike\", Jes\u00fas Rodolfo \r\nBerm\u00fadez, who was then Vice Minister of Finance, opened trusts in BIV to in the \r\nname of the Republic: one for 1,500 million dollars, through a promissory note \r\nat 18 months and a 14.5% rate, another for 700 million bolivars, and a third one \r\nfor 1.413 million dollars.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">According \r\nto the information at the time, the Ministry of Finance used that scheme to \r\nhonor payment commitments to public entities and private companies, but \"the \r\npromissory notes ended up injecting gas into the parallel currency market,\" El \r\nUniversal reported on July 18, 2004. \"In other cases, the companies demanded \r\nbuyers, mainly banks and brokerage firms, to pay the promissory note at 100% of \r\ntheir face value, whereby financial institutions acquired US dollars at Bs. \r\n1,600, exactly the price at which the Government gave foreign currency to the \r\npriority sectors of the economy in 2003,\" adds the release.<\/p>\n\n\n<figure class=\"wp-block-image size-medium\"><img loading=\"lazy\" decoding=\"async\" width=\"596\" height=\"776\" src=\"https:\/\/armando.info\/wp-content\/uploads\/2020\/12\/pp-3.jpg\" alt=\"\" class=\"wp-image-52042\"\/><figcaption>Property deed of one of the companies registered in the Virgin Islands<\/figcaption><\/figure>\n\n\n<p class=\"wp-block-paragraph\">El \r\nNacional newspaper published in 2007 information about the management of BIV \r\nduring the Ch\u00e1vez government, summarizing Gonz\u00e1lez Dell\u00e1n's step through the \r\ninstitution as follows: \"Leonardo Gonz\u00e1lez Dell\u00e1n, close to Copei (political \r\nparty), was appointed president of BIV in November of 2002, but he left in July \r\nof 2004. By then, the delinquency reached 49%.\"<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">In \r\nthe book <I>El gran saqueo<\/I> (The great sacking) by Carlos Tablante and Marcos \r\nTarre, Leonardo Gonz\u00e1lez Dell\u00e1n is identified as one of the financial \r\n\"operators\" who benefited during the Ch\u00e1vez administration through securities \r\nnegotiations and transactions that allowed them to take advantage of the \r\n\"exchange differential\".&nbsp;<\/p>\n\n\n<h2 class=\"wp-block-heading\">From Tax Havens to Earthly Heavens<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Son \r\nof the former Copei-member senator, Eudoro Gonz\u00e1lez, and brother of the current \r\ndeputy of Primero Justicia (political party), Eudoro Gonz\u00e1lez, Leonardo Gonz\u00e1lez \r\nDell\u00e1n met Ch\u00e1vez at the beginning of his government and ended up forming part \r\nof his government. The papers of Mossack Fonseca confirm that Gonz\u00e1lez Dell\u00e1n's \r\nrelationship with the law firm and the companies in tax havens did not end with \r\nBlue Crest Holdings S.A. In December 2010, representatives of J. A. Fern\u00e1ndez y \r\nAsociados, another Panamanian law firm, representing the former president of \r\nBIV, contacted Mossack Fonseca to request information on the availability to \r\n\"reserve\" some companies.<\/p>\n\n\r\n\n<p class=\"wp-block-paragraph\">\"Regarding \r\nthe company concerned, we confirm that the sole shareholder is Leonardo Gonz\u00e1lez \r\nDell\u00e1n. Therefore, we request you to prepare a share certificate for the entire \r\nshare capital in favor of Gonz\u00e1lez Dell\u00e1n,\" reads an email dated December 7, \r\n2010, sent from J. A. Fern\u00e1ndez y Asociados to executives of Mossack Fonseca. \r\nThe company was Rodsal Company Limited, registered by Mossack Fonseca on August \r\n5, 2010, in the British Virgin Islands. \"The company is authorized to issue a \r\nmaximum of 50,000 shares without par value of the same class of shares,\" \r\nestablished the register of the company, whose shareholder until July 2013 was \r\nLeonardo Gonz\u00e1lez Dell\u00e1n. Previously, there was a change of directors and \r\nfinally a certificate was issued with the 50 thousand shares in favor of \r\nWeltrust, a Swiss company, and the law firm Python &amp; Peter became its \r\nsettlement agent until the company was dissolved in November 2015. The documents \r\nof Mossack Fonseca prove that the former president of BIV also acquired in July \r\n2011 company Gran Rex Alliance, registered in Panama on May 11, 2010, with an \r\nauthorized capital of 10 thousand dollars, divided into 10 thousand shares of \r\none dollar to bearer. In this case, the papers show that the Uruguayan law firm \r\nEstudio Posadas &amp; Vecino Consultores Internacionales transferred to Mossack \r\nFonseca all the documents related to the origin of the company. It was not \r\npossible to contact Gonz\u00e1lez Dell\u00e1n for this work. Sources consulted indicate, \r\nhowever, that he lives in Europe. In 2012, celebrity magazines extensively \r\nreviewed his wedding in Las Vegas, USA, with the former miss and Venezuelan \r\nmodel, Aida Y\u00e9spica.
